Silence can hide more than any locked archive. A new lawsuit alleges that Black infants were enrolled in an experimental vaccine trial for a respiratory virus at a major hospital, without informed consent, and that several died shortly after receiving the investigational product.

At the center is a claim that medical ethics were not merely bent but ignored, despite the existence of institutional review practices and the basic doctrine of informed consent that grew out of the Nuremberg Code. Families say they believed their babies were receiving routine pediatric care, not a candidate vaccine being tested for immunogenicity and adverse events. Only through recently surfaced records, they argue, did they learn that their children were research subjects in a study targeting a respiratory pathogen.
Most disturbing is the racial pattern the plaintiffs describe. According to the complaint, Black infants formed the core study population while white infants were largely absent, raising allegations of discriminatory subject selection in violation of standard clinical trial design and bioethics norms. The suit seeks damages and a public accounting, but its sharper demand is moral: that a health system built on trust confront what was done to families who say they were never asked.
