Open weights need brakes. Policymakers are considering how to reduce harm after model parameters can be downloaded, altered, fine-tuned, and run beyond any developer's control. That debate is overdue. Once weights circulate, inference occurs on private hardware, while provenance, access controls, and post-release monitoring lose force. The file outlives its maker.
Blanket bans would fail. Open-weight research supports auditing, local deployment, and competition, yet the same distribution method can lower the cost of adapting systems for fraud, abuse, or automated targeting. The better target is capability. Rules could require risk evaluations before release, reportable red-team results, and tiered access when models cross defined thresholds for autonomy, tool use, or scalable misuse. Enforcement still has limits.
Business cannot outsource this. Firms that leverage open weights must build a closed-loop safety process: track derivatives, publish model cards, test fine-tunes, and preserve incident reporting after distribution. A moat is not secrecy. It is evidence that a company can manage supply-chain exposure when competitors treat safety as a zero-sum burden rather than a product duty. Act before release. Investors should demand release gates, traceable provenance, and clear liability; otherwise, the apparent savings from open distribution can become costly downstream failures.
